Terms & Conditions - Mis-sold Investment

We have tried to make our Terms and Conditions as clear and transparent as possible by using easy to understand language. If there is anything in this document that you are unsure about please call us for a more detailed explanation.

I hereby appoint Goodwin Barrett Ltd to act on my behalf as my sole representatives in respect of my claim for a mis-sold Investment. A mis-sold investment is when you have been given inappropriate financial advice to invest and lost money as a result of this advice. Examples of the sort of products include Stocks and Shares ISAs, Unit Trusts and Investment Bonds. I have provided all information/paperwork that I have in my possession as required by Goodwin Barrett to help with my claim. I shall not enter into any agreements with my bank or financial adviser without first consulting Goodwin Barrett. I have checked any legal expenses insurance I may have e.g. with my home insurance, to see if I can make a claim using that service.

In consideration of this Goodwin Barrett will:

Prepare any necessary correspondence to my bank or financial adviser asking it to investigate ALL Investments in my name
Review all information provided by my provider in relation to the claim
Provide representation with the Financial Ombudsman, as applicable

Cancellation

Goodwin Barrett can terminate this agreement at any time and no fee will be payable by you if we think there are no grounds for a claim or that your claim is unlikely to succeed. You have the right to cancel the contract by telephone, email or in writing to Goodwin Barrett within 14 days of signing the contract and you will not be charged. If you terminate after 14 days, and we have submitted your claim, and an offer of compensation is subsequently made, we will charge our full fee as detailed below. If you cancel after 14 days, and we have submitted your claim, and we are unsuccessful, we will not charge a fee.

Law & Jurisdiction

The law applicable to this contract shall be English law and the parties consent to the jurisdiction of the English courts in all matters affecting this contract.

Other important points

I am aware that I can pursue a claim for a mis-sold Investment myself directly with my bank or financial adviser and use the free services of the Financial Ombudsman Service (FOS) to do so.

I am aware that in some instances I may receive a call from my bank to confirm the details of the claim submitted by Goodwin Barrett.

Payment of our fee

Goodwin Barrett will endeavour to recover all monies in respect of my claim and undertake to forward any payment from my bank or financial adviser to me within seven days from the date received, subject to the agreed fee of 40% plus VAT – total fee payable 48%. We require that you promptly pay our fee no later than 7 days after you receive your compensation (if you are paid direct) or if you have no intention of accepting the offer and we recommend that you do so, 7 days after our recommendation. In the event that our fee remains unpaid we reserve the right to refer your case to third party Debt Collectors.

We will charge you a fixed fee of 40% plus VAT (total of 48%) of the gross amount of compensation you may receive from your claim.

The above fee illustration is not to be taken as an estimate of the amount likely to be recovered for you.

Please note the bank could use your compensation to pay off any debt you may have e.g. overdraft, or use it to pay back into your investment. Regardless of this our full fee would still be payable.
